US Surety Reinsurers Face Volatility Ahead of Jan. 1 Renewals
Primary surety carriers in the United States continue to post direct loss ratios that are low by historical standards, according to Willis Re's October market view. In contrast, reinsurers are experiencing heightened volatility because excess-of-loss structures expose them to large contractor and project defaults rather than steady attritional profit.
Recent large losses have broken through the higher retentions that primary writers have set. The Pine Gate Renewables Chapter 11 filing affected roughly $1.85 billion of surety bonds and surety-backed letters of credit, while the First Brands collapse could cost credit insurers between $300 million and $600 million. Fraud and double-pledging issues, such as those seen at Tricolor, add further due-diligence challenges.
Data-center construction is emerging as the biggest exposure. Alphabet, Amazon, Meta and Microsoft plan more than $700 billion of combined capital spending in 2026, often financed through special-purpose vehicles that hide the ultimate tenant or sponsor. This makes it difficult for reinsurers to assess the underlying credit, especially when a single project may involve credit, surety, property, construction and cyber cover simultaneously.
Willis Re expects the disconnect between primary carriers and reinsurers to persist. Reinsurers are likely to keep supporting surety for multi-line clients but will differentiate more sharply by cedent. Price increases will focus on programs with loss histories, and large-loss aggregation and exposure data quality will outweigh headline loss ratios. The macro environment adds pressure, with US 10-year Treasury yields at 5.31 % and an anticipated 8 % rise in US insolvencies.
Why it matters
Reinsurers' handling of large surety losses and data-center exposure will directly affect pricing and terms for primary carriers and their insured contractors.
